1. Introduction

Please read these Terms of Use and Privacy Policy carefully before using any JYS Infotech Google Workspace add-on or service. These Terms of Use and Privacy Policy (the "Terms" or "Terms of Use") constitute a legally binding agreement between you and JYS Infotech Private Limited ("JYS Infotech", "we", "us", "our") that governs your use of our Google Workspace add-ons and related services.

JYS Infotech Private Limited takes data protection matters very seriously and is committed to ensuring that the privacy of users who use our services is protected. By accessing, installing, or using any part of our services, you agree to be bound by these Terms.

If you do not agree to these Terms, do not access, install, or use our services.

2. Definitions

  • JYS Infotech, we, us, our: JYS Infotech Private Limited, a company incorporated under the laws of India;
  • Service or Services: Any of our Google Workspace add-ons, including but not limited to Remove Duplicates - Data Cleaner, StripeSync, and any other add-ons we may offer from time to time;
  • Google Workspace: Google's suite of cloud-based productivity and collaboration tools, including Google Sheets, Google Docs, Google Drive, and Gmail;
  • User, you, your: Any individual who installs, accesses, or uses our Services;
  • Personal Data: Any information relating to an identified or identifiable individual, including but not limited to name, email address, IP address, and user account credentials;
  • User Content: Any data, information, or materials that you create, upload, submit, store, or otherwise make available through the Service, including but not limited to spreadsheet data, documents, files, and configuration settings;
  • Google User Data: Any data accessed from your Google account through Google APIs, including but not limited to data from Google Sheets, Google Drive, Google Calendar, and Gmail;
  • Sensitive Data: Any data that requires special protection, including but not limited to financial information, health information, personal identification numbers, passwords, authentication credentials, and any data classified as sensitive under applicable data protection laws.

3. Acceptance of Terms

By accessing, installing, registering for, or using any part of our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Use, which form a legally binding agreement between you and JYS Infotech Private Limited.

Your use of our Services is also subject to our Privacy Policy, which is incorporated by reference into these Terms. Please read our Privacy Policy where we describe how we collect, process, and protect your Personal Data and Google User Data.

Depending on your location, you may have additional rights or obligations under applicable laws and regulations, including but not limited to the General Data Protection Regulation (GDPR) in the European Union, the California Consumer Privacy Act (CCPA) in California, and other applicable data protection laws.

4. License

Subject to the terms and conditions of these Terms, we hereby grant you a limited, non-exclusive, non-transferable, revocable, non-sublicensable license to access and use our Services for your business or personal purposes in accordance with these Terms.

Neither these Terms nor your access to or use of the Services grants you any rights, title, or interest in or to any intellectual property rights related to the Services. All rights, title, and interest in and to the Services remain with JYS Infotech or our licensors.

5. Acceptable Use

You agree to use our Services only in accordance with applicable laws, these Terms, and our documentation. You are solely responsible for your conduct while using the Services and for ensuring that your use does not violate the rights of others or our operational standards.

You agree that you will not, and will not permit others to:

  • Access or use the Services for any unlawful, harmful, or fraudulent purpose, or to promote illegal activities;
  • Interfere with, disrupt, or compromise the integrity, performance, or security of the Services or any third-party data contained therein;
  • Use the Services in any way that could disable, overburden, or impair its functionality or availability for others;
  • Circumvent, disable, or otherwise interfere with security-related features or technical restrictions of the Services;
  • Attempt to gain unauthorized access to any portion of the Services, other users' accounts, or any connected systems or networks;
  • Reverse engineer, decompile, disassemble, or attempt to derive source code or structure from the Services except to the extent permitted by applicable law;
  • Copy, modify, create derivative works of, resell, distribute, or commercially exploit any part of the Services without our express written permission;
  • Upload or distribute content that contains malware, viruses, ransomware, or other harmful components;
  • Transmit or store content that violates intellectual property rights, privacy rights, or any laws or regulations;
  • Use the Services to create or promote a competing product or service.

Violation of these Acceptable Use terms may result in the suspension or termination of your access to the Services and legal action where applicable.

6. Data Protection Mechanisms for Sensitive Data

JYS Infotech recognizes the importance of protecting sensitive data and has implemented comprehensive data protection mechanisms to safeguard such information. Our data protection measures include:

6.1. Encryption

  • Data in Transit: All data transmitted between your device and our Services is encrypted using industry-standard Transport Layer Security (TLS) protocols, ensuring that data cannot be intercepted or read during transmission.
  • Data at Rest: Any sensitive data stored on our servers (if applicable) is encrypted using Advanced Encryption Standard (AES) encryption with appropriate key management practices.

6.2. Access Controls

  • We implement role-based access controls to ensure that only authorized personnel have access to sensitive data, and only to the extent necessary to provide support or maintain the Services.
  • All access to sensitive data is logged and monitored for security purposes.
  • Our employees and contractors are bound by strict confidentiality agreements and receive regular training on data protection practices.

6.3. Authentication and Authorization

  • Our Services use Google OAuth 2.0 authentication, which means we never store your Google account passwords.
  • Access to Google User Data is granted only with your explicit consent through Google's authorization process.
  • You can revoke access to your Google account data at any time through your Google Account settings.

6.4. Data Minimization

  • We collect and process only the minimum amount of data necessary to provide the Services.
  • We do not access, store, or process sensitive data unless it is absolutely necessary for the functionality of the Service you are using.
  • For most of our add-ons, data processing occurs locally within your Google Workspace environment, and we do not transmit sensitive data to our servers.

6.5. Security Safeguards

  • We maintain appropriate technical and organizational measures to protect against unauthorized access, alteration, disclosure, or destruction of sensitive data.
  • Our infrastructure is regularly updated with security patches and monitored for potential vulnerabilities.
  • We conduct regular security assessments and audits to ensure the effectiveness of our data protection measures.
  • We use secure, industry-standard hosting providers that comply with relevant security certifications and standards.

6.6. Third-Party Service Providers

  • When we use third-party service providers to host or process data, we ensure they maintain appropriate security safeguards and comply with applicable data protection laws.
  • All third-party service providers are contractually bound to protect your data and use it only for the purposes we specify.

6.7. Incident Response

  • We have established procedures for responding to security incidents, including data breaches.
  • In the event of a security incident affecting your data, we will notify you and relevant authorities as required by applicable law.

7. Collection and Use of Personal Information

We collect personal information from users including (at minimum) first and last names, and a Google Workspace email address to be used for authentication and service delivery. When a user installs or uses our Services, we may collect:

  • Basic account information (name, email address) for authentication and service delivery;
  • Usage data to improve our Services and troubleshoot issues;
  • Billing and payment information (if applicable) via our payment processing partners such as PayPal or similar applications, for paid versions of our Services.

Your email address may be used to send you periodic product newsletters, offers, and usage tips. You can opt out of promotional emails at any time, but will still receive communications such as receipts, confirmation emails, and customer service updates that are considered necessary to provide the service to you.

We use the information collected to deliver services, update our records, communicate with you about products and services, and generally maintain your accounts with us. We do not share, sell, trade, or rent your personal information to third parties except as described in this Privacy Policy.

8. Google User Data - Collection, Retention, and Deletion

8.1. How We Access Google User Data

Our Google Workspace add-ons access your Google User Data through Google APIs in accordance with Google's API Services User Data Policy. We only access the minimum amount of data necessary to provide the functionality of each specific add-on.

Example - Remove Duplicates - Data Cleaner Add-on: This add-on accesses your Google Sheets data to identify and remove duplicate entries. The add-on processes data locally within your Google Sheets environment and does not transmit your spreadsheet data to our servers. We only access:

  • Google Spreadsheet data (Read & Write access) - to read and modify your spreadsheet as requested
  • User Info (Email Address & Name) - for authentication and service identification

Example - StripeSync Add-on: This add-on synchronizes data between Google Sheets and Stripe. The add-on accesses:

  • Google Spreadsheet data (Read & Write access) - to read and update your spreadsheet
  • User Info (Email Address & Name) - for authentication
  • Stripe API data - to synchronize payment information (handled through Stripe's secure API)

8.2. Data Storage and Processing

For most of our add-ons, data processing occurs locally within your Google Workspace environment. We do not store your Google User Data on our servers unless it is absolutely necessary for the functionality of the Service. When data must be temporarily processed on our servers:

  • Data is encrypted in transit and at rest
  • Data is processed only for the specific purpose you requested
  • Data is not used for any other purpose, including advertising or marketing
  • Data is not shared with third parties except as necessary to provide the Service

8.3. Data Retention

We retain Google User Data only for as long as necessary to provide the Services to you, or as required by law. Specifically:

  • Active Accounts: We retain your Google User Data while your account is active and you are using our Services.
  • Inactive Accounts: If you stop using our Services and your account becomes inactive, we will retain your data for a period of up to 12 months, after which we will securely delete it, unless we are required by law to retain it for a longer period.
  • Account Deletion: Upon your request to delete your account, we will delete your Google User Data within 30 days, except where we are required to retain it for legal, regulatory, or legitimate business purposes.
  • Legal Requirements: We may retain certain data for longer periods if required by applicable laws, regulations, or legal proceedings.
  • Backup Data: Data stored in backup systems will be deleted in accordance with our backup retention policy, which typically retains backups for up to 90 days.

8.4. Data Deletion

You have the right to request deletion of your Google User Data at any time. To request deletion:

  • Send an email to support@jysinfotech.com from the Google account associated with the add-on
  • Include your name, email address, and specify which add-on(s) you are using
  • We will process your deletion request within 30 days of receipt
  • You can also revoke access to your Google account data at any time through your Google Account permissions page

Upon deletion:

  • We will permanently delete your Google User Data from our systems
  • We will remove your account information from our databases
  • Any cached or backup copies will be deleted in accordance with our retention policies
  • We will confirm the deletion in writing via email

Note: Some data may be retained if required by law or for legitimate business purposes (such as resolving disputes or enforcing agreements), but such data will be retained only for the minimum period required.

8.5. Data Portability

In compliance with GDPR and other applicable data protection laws, you have the right to receive a copy of your Google User Data in a structured, commonly used, and machine-readable format. To request your data, contact us at support@jysinfotech.com.

9. Business Information and User Content

Information that is collected, processed, or stored by our Services is considered confidential. We will not view Business Information or User Content except as necessary to appropriately support the service or as required by law.

Business Information includes app data, documents, files, configuration settings, and any other business information stored or processed through our Services.

We will not view Business Information, except:

  • As necessary to appropriately support the service
  • For the purpose of anticipating, diagnosing, supporting, or resolving any problems that might limit or disrupt the quality of our customers' service experience
  • As required by law or legal process
  • With your explicit consent

You are solely responsible for your User Content. You represent and warrant that you own or have obtained all necessary rights, licenses, and permissions to use and process User Content through our Services.

10. Cookies and Tracking Technologies

Our website and Services may use "cookies" and similar tracking technologies. A cookie is a piece of data stored on a site visitor's device to help us improve your access to our site and identify repeat visitors.

We use cookies for:

  • Authentication and session management
  • Remembering your preferences and settings

  • Issues with Google Workspace or Google APIs
  • Force majeure events or causes beyond our reasonable control

We make commercially reasonable efforts to minimize downtime and respond to incidents promptly. We reserve the right, in our sole discretion, to modify, suspend, or discontinue all or any part of the Services at any time, temporarily or permanently, with or without notice.

12. Warranties and Limitation of Liability

12.1. Disclaimer of Warranties

The Services are provided on an "as is" and "as available" basis. To the fullest extent permitted by applicable law, we disclaim all warranties, whether express, implied, statutory, or otherwise, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, or results from use of the Services.

We do not warrant that:

  • The Services will be uninterrupted, timely, secure, or error-free
  • The results that may be obtained from the use of the Services will be accurate, reliable, or suitable for your needs
  • Any bugs, errors, or defects will be corrected
  • The Services or the servers that make it available are free from viruses, malware, or other harmful components

12.2. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall JYS Infotech (including our affiliates, officers, directors, employees, agents, contractors, and licensors) be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including without limitation loss of profits, revenue, data, or use, business interruption, or procurement of substitute services.

To the extent permitted by law, our total aggregate liability to you for any direct damages arising out of or relating to these Terms or your use of the Services shall not exceed the amount you paid us for the Services in the six (6) months immediately preceding the claim, or one hundred dollars ($100), whichever is greater.

13. Termination

You may cease use of the Services at any time by uninstalling the add-on from your Google Workspace account. You may also revoke access to your Google account data at any time through your Google Account settings.

These Terms will remain in full force and effect while you access or use the Services. In the case of violation of these Terms, we reserve the right to terminate your access at any time, with or without cause, with or without notice, with immediate effect and without liability.

Upon termination of your access, you may request a copy of your User Content stored in the Service, provided your request is made within thirty (30) days of the effective termination date. We will make reasonable efforts to provide you with access to such data in a common, machine-readable format. After the expiration of the 30-day period, we reserve the right to permanently delete your User Content in accordance with our data retention policies, unless otherwise required by applicable law.

14. Changes to These Terms

We reserve the right to modify or update these Terms at any time, at our sole discretion. When we make material changes to these Terms, we will:

  • Post the updated version on our website
  • Update the "Effective Date" at the top of this document
  • Where appropriate, provide additional notice via email or through the Services

Any such changes will become effective on the date indicated in the updated Terms, unless a later date is specified. We encourage you to review these Terms periodically to stay informed of any changes.

If you do not agree to the updated Terms, you must stop using the Services before the changes become effective. Your continued use of the Services after the effective date of the updated Terms constitutes your acceptance of the changes.

15. Your Rights

Depending on your location, you may have certain rights under applicable data protection laws, including:

  • Right to Access: You have the right to request access to your Personal Data and Google User Data
  • Right to Rectification: You have the right to request correction of inaccurate or incomplete data
  • Right to Erasure: You have the right to request deletion of your data (as described in Section 8.4)
  • Right to Restrict Processing: You have the right to request restriction of processing of your data
  • Right to Data Portability: You have the right to receive your data in a structured, machine-readable format
  • Right to Object: You have the right to object to processing of your data for certain purposes
  • Right to Withdraw Consent: You have the right to withdraw your consent at any time
